Terms & Conditions

Installation Criteria

- As part of your machine purchase, Brother will provide delivery and a basic installation of your machine via our Technical Service Provider Network.
- Installation is complimentary within 30km from an Authorised Brother Technical Service Provider, outside of service area. Brother will advise the Customer of additional travel costs prior to installation and the Customer will be required to pay such costs directly to the Technical Service Provider.
- Installation covers delivery of the machine and basic installation of Brother software and a device driver on a single computer and basic setup as covered in the Quick Setup Guide (the Installation Service).
- The Installation service includes the basic set up of date and time, fax, scan to email and basic instruction for how to use the machine (including scanning and faxing functions and entering one touch and speed dials).
- The Installation service does not cover any advanced setup and programming of the machine beyond basic instruction, any additional software or infrastructure updates or changes, and repairing and troubleshooting computer or operating system issues.
- Network machines can be installed on the Customer's network if there is an existing infrastructure (including any cables required).
- If the Customer wishes to obtain the Installation service, the Customer must contact Brother to arrange for this service within 4 weeks from the date of purchase of the machine.
- Installation services are only available for Brother MFCL8690CDW, MFCL9570CDW, HLL9310CDW, MFCL5755DW, MFCL6700DW, MFCL6900DW, HLL6400DW, MFCJ6945DW.

General

- In providing the Installation service, Brother is not responsible for any loss or damage caused by the Authorised Brother Technical Service Provider's negligent conduct, or misuse, abuse, neglect or accident by the Customer or the Authorised Brother Technical Service Provider, or any failure of the machine or Installation service due to network or power supply irregularities, and has no liability for any direct loss or damage incurred by the Customer arising out of the provision of the Installation service, except to the extent that such loss or damage is caused by - - Brother's negligent conduct (subject to the exclusion of certain direct losses as provided below).
- Brother will not be liable for any indirect loss or any direct loss of profit, loss of revenue, loss of use, loss of or corruption to data, or loss of anticipating savings, connected with the machine and provision of Installation Services (whether in contract, tort, under statute or otherwise).
- The Installation service is additional to and does not replace any of the legal rights of a consumer against either a manufacturer or a supplier under the Consumer Guarantees Act 1993 (if applicable).
- If the machine purchased is being used for business purposes then the Customer acknowledges that the Consumer Guarantees Act will not apply to the purchase of the machine and/or the Installation service.
- The Customer also acknowledges that no other warranties either express or implied by law are made with respect to this machine.

Print Audit Software

- The Customer agrees to Brother installing print audit software on the Customer's server.
- The Customer (by negotiation) will provide Brother with the necessary network permissions to allow Brother to remotely monitor the machine print volumes and consumable replacements.
- The Customer agrees to be contacted by the reseller when an alert notification has been received by Brother, for the purposes of ascertaining whether consumables will be or are required by the Customer.

Privacy Statement

- Brother will hold any and all personal information of the Customer, in accordance with the provisions of the Privacy Act 1993. The Customer has the right to access and request correction of their own personal information. Any personal information held by Brother will be used only for the purpose for which it was provided and will not be retained for any longer than necessary. It will not be disclosed to any other person or agency without the individual's express consent, unless required by law, or if disclosure is necessary in connection with any breach of these Terms and Conditions.
